Wilson-Plame Civil Suit Dismissed

A federal judge has dismissed a lawsuit by outed spy Valerie Plame and her husband against Vice President Dick Cheney and other top Bush administration officials.

U.S. District Judge John Bates said the lawsuit raises “important questions relating to the propriety of actions undertaken by our highest government officials.” But in a 41-page decision, he found that Plame and her husband, former U.S. Ambassador Joseph Wilson, failed to show the case belongs in federal court.

Now Cheney can keep the royalties from his upcoming book”If I outed Valerie Plame” about how he would have gone about it. Taking time off from his hunt for the real leaker of course.

Why didn’t your initial posting longer and more elaborate Shaun, as are your constant Bush-bashing postings? (If Joe G. were to post something, it would be amusing if it didn’t take up half the space on the current Web page the way other postings involving Bush and his people have.)

    ”If I outed Valerie Plame”

Why not, since Putin never wrote anything about Livitnenko’s murder.

Actually, his secrecy practices are so thorough that Putin an the old Kremlin gang would be impressed, and Hillary Clinton would appreciate learning what she doesn’t know and practice already.

It would be interesting to get a legal opinion on what grounds are needed to prove a case belongs in federal court- or if this is just how the DOJ works in the Bush administration.

I don’t understand the ruling, either, Kimrit.

Okay, the judge (a Bush appointee, BTW) ruled that under federal law, administration officials are protected from suits related to official duties. Does that include illegal or criminal acts?
If the case does not belong in federal court, then where does it belong – the SC?

I hope some commenters who understand law better thant I do chime in.

KR and Domjat – Congress passed a law making government officials immune from civil lawsuits. The judge didn’t say the case had no merits, just because of this law the Plames can’t sue. Will have to wait to see what Balkin says.

    Why the repeat from July?

It was startling to read my own comment without , at first, any memory of having made it.
