
Donald Trump is issuing illegal orders to the military
Article 92 of the Uniform Code of Military Justice (UCMJ) addresses the failure to obey orders, stating that service members must obey lawful orders. An order is considered unlawful if it requires a service member to commit a crime, violates the Constitution, or is otherwise illegal. Service members have a duty to refuse an order that is clearly illegal, as disobeying such an order can protect them from criminal liability.
Basically, this means that people in the military do not have to follow illegal orders, no matter who issues them, whether it’s from a sergeant or the president of the United States. Donald Trump and Republicans don’t like that soldiers were reminded of this.
Six democratic lawmakers posted a video to X last week where they said that “threats to our Constitution” are coming “from right here at home,” and repeatedly urged the military and intelligence community to “refuse illegal orders.” Trump and Republicans are calling this reminder “seditious” and that posting it was “treason.”
One could argue that Donald Trump and Republicans believe that exercising free speech is seditious and treasonous.
The Pentagon, led by Pete Hegseth, said Monday that it is investigating Democratic Sen. Mark Kelly, a retired US Navy captain and one of the Democrats who made the video, in light of “serious allegations of misconduct” the department has received against him, and could even recall him to active duty to face a court-martial or administrative punishment.
The other Democrats who made the video are Sen. Elissa Slotkin and Reps. Jason Crow, Maggie Goodlander, Chris Deluzio, and Chrissy Houlahan. Mark Kelly was a senior officer, so he will forever remain available for recall. The other Democrats are not eligible for recall, so the Trump administration will have to invent some other bullshit to punish them for speaking out.
The Democrats did not mention any specific orders from Trump that could be considered illegal. If anything, it’s just good advice that they’re giving. It would be hard to find anything in it that is seditious or treasonous. And in case you didn’t notice today in the James Comey and Leticia James cases, the Trump administration has been very bad lately at proving anything in court.
The Pentagon issued a statement saying, “All servicemembers are reminded that they have a legal obligation under the UCMJ (Uniform Code of Military Justice) to obey lawful orders and that orders are presumed to be lawful,” the statement said. “A servicemember’s personal philosophy does not justify or excuse the disobedience of an otherwise lawful order.”
No one is arguing that lawful orders should be disobeyed, and the Democratic senators did not advise anyone to disobey lawful orders.
But since the Democratic senators didn’t mention any specific examples of Donald Trump issuing illegal orders, I will.
The president (sic) ordering troops to invade cities illegally or attack American citizens is in an illegal order. And I’m no lawyer, but I do believe it’s illegal to order the military to kill civilians in the Caribbean. What are we, fucking pirates? Maybe Donald Trump believes he’s Captain Jack Sparrow. He does like the booty.
Donald Trump’s military has fired missiles at least 22 boats in the Caribbean and along the Pacific coast, resulting in the death of at least 83 people. Trump claims that they were all drug smugglers, but since they were never apprehended or questioned, we don’t know who they were. This is the same moron who believed a large part of our fentanyl problem was coming from Canada.
The military is killing first and not even bothering to ask questions later, all because of Donald Trump’s bloodlust.
The person who should be going to jail for all of this is Donald Trump. I also wouldn’t mind if Pete Hegseth were thrown in there with him.
