The oaths of office for the President and members of Congress require they swear to uphold and defend the Constitution of the United States.
Our Constitution mandates a separation of powers not only between the three branches of the federal government, but also a separation of powers between the federal government and the states, reserving powers not explicitly granted in the Constitution to the federal government to be held by the states and by the people (see Amendments IX and X, the last two amendments of those comprising the Bill of Rights).
Could it be argued that the members of Congress who voted on the special law this past Sunday, and the President who signed this law, broke their oaths of office?
