If TMV counts any judicial originalists among its number, I have a question for y’all:
Originalists seem to hate it when American courts cite to foreign sources of law (aside from English common law). But there is a long history of such citation, dating back to the founding era. Isn’t this a paradox? How to originalists justify this seeming break with their own philosophy?
