This would seem to be an area libertarians and liberals can agree.
Agree in what way?
That the “prolonged detention” concept is a threat to individual liberties.
It would not apply to U.S. citizens and would be the equivalent of prisoners of war without having prisoner of war camps.
Why after the failures of the Clinton Administration does the left want to go back to the idea of criminalization of terrorist committing terrorist acts outside the U.S. Does she really want to give civilina judges control, authority, and second guess rights over military operations outside the U.S.
Good on Rachel Maddow and GG for their consistency. I didn't think anyone at MSNBC had it in them.

FYI, I can't remember a time where she ever presented a “party line” point of view that she didn't demonstrate through logical argument. Her dedication to the rule of law and ability to point out logical problems with advocates' talking points always makes for good interviews.
She took apart David Frum one night and reduced him to personal insinuation. She obviously deconstructs this Administration's position in this case too.
Hemm, I don't watch her much and when I do, I find her smirkiness pretty annoying- but to the extent that she's not a syncophantic watercarrier, I'll give credit where due.

I'll be the first to agree she has some “quirks.” I think those are geek smirks, the kind you see when a math geek looks at you condescendingly for not knowing Pi to the 14th decimal place. Her expertise is not math, but historical political policy.
Anyway, I've actually come to appreciate her wonkish idiosyncrasies.

You haven't been watching either Maddow or Olbermann, then. I don't know about anyone else at MSNBC, but these two have been consistently upholding the same principles, values, and beliefs from Day One of Obama's presidency as they have for the past eight years.
GG says “the creation of a new system of indefinite preventive detention…is now sure to become a standard view of Democratic politicians and hordes of Obama supporters.”
Well, we'll see about that. This Obama supporter is spitting mad, because I actually believe in our Constitution, 'innocent til proven guilty' and the sanctity of the rule of law that has been our guiding light since the Magna Carta. I'm no more willing to let Obama slide on this than Cheney.
