As this intriguing CBS report shows, speculation is rife on who President Barack Obama could choose to replace David Souter on the Supreme Court:
Sorry I can't give any names, but I think he'll pick a judge. Scary Harry's (my name for Harriet Miers) nomination was derailed in part by lack of judicial experience. Even some Republicans got that one right.
I think that Obama will choose a seasoned jurist or maybe, a law professor. That suits his temperament.
Generally speaking, presidents nominate pols for the Court when they're looking for an easier confirmation process. A member of the Senate, for example, usually will have an easier time of getting confirmed than other candidates might.
While Obama will want to get his first Supreme Court nomination right, he won't feel constrained to play it safe ideologically, putting forward the name of a moderate. With 60 Democrats in the Senate now, even though one of them fought for the nominations of some very conservative justices, I think he can fairly well have his way.
I believe too, that his nominee will be a woman.
