President-elect Obama has hit the ground running and is already preparing plans to close Guantanamo Bay, a move championed by legal scholars (aka elitist terrorist-lovers in some circles) from both parties. But what to do with the detainees?
Under plans being put together in Obama’s camp, some detainees would be released and many others would be prosecuted in U.S. criminal courts.
A third group of detainees — the ones whose cases are most entangled in highly classified information — might have to go before a new court designed especially to handle sensitive national security cases, according to advisers and Democrats involved in the talks. Advisers participating directly in the planning spoke on condition of anonymity because the plans are not final.
The actual structure is yet to be determined, but it’s possible that Obama will propose a new court system that will be more transparent than Bush’s military tribunals but will stop short of treating detainees as if they have full constitutional rights. Symbolically, though, shutting down that detention center will be an important message to the rest of the world that America has changed, and it will probably help in building the alliances that Obama sees as essential to stabilizing Iraq and Afghanistan.

It would be a bit difficult for the incoming administration to prosecute the outgoing one for war crimes and treason, while still operating one of the main outposts for said crime.
Bush and Cheney/Bigoil are up against it. They're staring right in the maw of a horde of angry attorneys and Congress.
In a perfect world I would see the Bush administration and their Bigoil allies exposed and links drawn in conspiracy charges between supplying false information to Congress to declare war on Iraq, and Bigoil's covert influence to do so, to overtake control of the oil reserves there at the expense of soldier and civilian lives…not to mention all on the Public's tab and military hardware.
If BigOil wants the reserves in the Middle East, they're rich enough to hire mercinaries to go in and take it for them. America needs to factually, formally and publicly wash its hands of that affair. Then of course I'd like to see HUGE fines imposed on BigOil and their operatives.
The world would respect us more if we took care of our own criminal element first before we go out trying to straighten out other countries..
It will be interesting to see how Obama takes action on so many vital national security issues affecting our country at the same time. Let us pray that he uses some sound advice and judgement so as not to get us into a situation we will regret. This man scares me for many reasons, but I am optimistic enough to hope for the best.

Perhaps consider using a place like Alcatraz. Most of the prison is usable, build it back up. Have it all out there. while still being in America keep the “prisoners” off the main land.
