Word just issued this morning that the 9th Circuit US Court Of Appeals will issue their ruling on Proposition 8 at 10am on Tuesday February 7th.
This ruling will cover the issues of the Constitutionality of Proposition 8 as well as review the lower court opinion, the issues of standing and alleged bias on the part of Judge Walker.
Whatever the ruling is it will be appealed and so the battle is far from over. This is a 3 judge panel so the appeal would likely go first to the full appeals court sometime this year and then to the US Supreme Court in 2012-13 session.
I’m not sure the 9th will grant review en banc.
Agreed PJB, though I am not sure the USSC would take up the appeal prior to en banc by 9th
I always wondered how the vote would have turned out if Utah Mormons had not dumped millions of dollars into the California campaign system. I read about a family that admitted to giving away their child’s college fund to a fundraising committee…. crazy stuff. A middle class Utah family…dumped 50k into a fund to affect California’s marriage laws.
of course, you can’t believe everything you read these days. For some reason this sound somewhat illegal.
