If that was the case here, then there wouldn't be room in any county jail for all the "publicly intoxicated" people the police could pick up at a bar on a Friday night. A private home or private club would be protected, but not a bar, restaurant, hotel lobby, etc. Kind of wierd, because this is also a state where as long as I am with my child and they are over the age of 12, I can order beer, wine or mixed drinks in a restaurant or bar for them, and they can legally consume them. I know that it is technically illegal for bartenders to serve obviously drunk people, but usually that only happens when the patron is over-the-line drunk, picking fights or falling down or something. But I always thought bars were private establishments, and people cannot be arrested for being drunk in public when they are not, legally speaking, in public.
