Both want to use government to force people to behave in a way they think is morally righteous. Hey, jerkoffs, stop forcing me to wear a helmut when I&#039;m driving my motorcycle. If I&#039;m an adult, I should be able to decide if I want to wear a seatbelt. If I want to watch porn, it&#039;s none of your damn business. If I want to get drunk in a bar, leave me the hell alone. If that was the case here, then there wouldn&#039;t be room in any county jail for all the &quot;publicly intoxicated&quot; people the police could pick up at a bar on a Friday night.  I&#039;d be surprised if this isn&#039;t the case in Texas too.</description>

		<description>Any establishment that is open for anyone to walk in off the street is subject to &#039;public drunkeness&#039; laws in Texas. A private home or private club would be protected, but not a bar, restaurant, hotel lobby, etc.

Kind of wierd, because this is also a state where as long as I am with my child and they are over the age of 12, I can order beer, wine or mixed drinks in a restaurant or bar for them, and they can legally consume them. Go figure.</description>

But I always thought bars were private establishments, and people cannot be arrested for being drunk in public when they are not, legally speaking, in public.</description>
