What exactly is the law on this sort of thing? I know that it is technically illegal for bartenders to serve obviously drunk people, but usually that only happens when the patron is over-the-line drunk, picking fights or falling down or something. But I always thought bars were private establishments, and people cannot be arrested for being drunk in public when they are not, legally speaking, in public.
It might be that they invite the individual to come on outside to talk where it’s quieter, and then, once outside, say, on the street corner, arrest them.
Any establishment that is open for anyone to walk in off the street is subject to ‘public drunkeness’ laws in Texas. A private home or private club would be protected, but not a bar, restaurant, hotel lobby, etc.
Kind of wierd, because this is also a state where as long as I am with my child and they are over the age of 12, I can order beer, wine or mixed drinks in a restaurant or bar for them, and they can legally consume them. Go figure.
I live in Wyoming and don’t know if we have a similar law (but I doubt it–you can drive with open containers in your car here). If that was the case here, then there wouldn’t be room in any county jail for all the “publicly intoxicated” people the police could pick up at a bar on a Friday night. I’d be surprised if this isn’t the case in Texas too.
I’m really getting sick of the Christian Right and The Fascist Left having so much power in this country. They are two sides of the same coin. Both want to use government to force people to behave in a way they think is morally righteous. Hey, jerkoffs, stop forcing me to wear a helmut when I’m driving my motorcycle. If I’m an adult, I should be able to decide if I want to wear a seatbelt. If I want to watch porn, it’s none of your damn business. If I want to get drunk in a bar, leave me the hell alone. Spend your time going to church or your bad poetry readings and get off my back!

Josh, faschism is a right wing version of authoritarinism much like communism is a left wing authoritarin governing style.
