Rumsfeld has already been indicted for violating French law against a French citizen, in exactly the same way Polanski is accused of violating US law against a US citizen. As far as I know, France has not demanded his extradition, but we have now demanded extradition of Polanski, which makes our refusal to deliver alleged criminals to our allies very hypocritical. Your point about war crimes is relevant, but not to the French citizen, who was not in a war, and because Rumsfeld is not accused of international war crimes. However, the US does have an obligation to investigate for war crimes, and according to Geneva if they don't then it can be referred to the international criminal court and <i>then</i> you'd have a point.
