I have discovered an unfair disparity in access to a vital resource based on the economic condition of the consumer. This disparity is not just egregious, but it threatens the very core of our American way of life. People routinely get denied adequate and competent service on the basis of their ability to pay, even though they have a right to it, while the rich eat up all the resources with their ability to access the best and brightest in the field. And in the interest of fairness, the federal government needs to find a solution and impose it on the industry as a whole.

I refer, of course, to legal representation.

Oh, sure, in an emergency, the government will foot the bill for a public defender to represent the poor and indigent, but that’s hardly a comfort to those who needed a lawyer before getting into the emergency condition in the first place. Besides, while we have many dedicated public defenders, it’s hardly a news flash that the wealthy can afford much better representation and have a much better chance of prevailing in court in criminal cases. When the poor, working class, and middle class end up in that emergency situation, they can lose their homes and property to pay for decent legal care — and that shouldn’t happen in America, should it?

After all, unlike health care, Americans actually do have a Constitutional right to legal representation in court. Some will scoff and say the lack of a lawyer, or a bad lawyer, can’t cause your death. Those critics may want to talk with the inmates who got freed from Death Row and lifetime prison sentences after having mediocre attorneys lose cases where the defendant was really innocent. Bad or nonexistent legal representation can take years off of your life, and can definitely get you killed.

Even beyond that, though, the wealthy and connected have access to a much wider range of legal services than even the middle class can afford. Estate planning, trust funds, tax shelters — all of these can be expertly provided to those with the resources to afford them, while other Americans get second-class status in our legal system. For those who aspire to egalitarianism of result, this arrangement should be such an affront that it demands real action — now.

I propose that the government impose a single-payer system on the legal profession. Instead of charging private fees, all attorneys would have to send their bills to LegalCare, a new agency in the federal government. Because the government can bargain collectively, they can impose rational fees for legal services instead of the exorbitant billing fees attorneys now charge. Three hundred dollars an hour? Thing of the past. Everyone knows that the government can control costs through price-setting; now we can see this process applied to the legal system, where the government has a large interest in seeing cost savings.

How will we pay for LegalCare? I take a page from the House surtax method of funding health-care reform here, which will disproportionately hit doctors in a wide variety of disciplines. In this case, I propose a 5.4% surtax on lawyers, judges, lobbyists, and political officeholders at the state and federal level. They’re the ones who have enriched themselves through this inequity in the legal system. After all, why should we all have to pay for the single-payer legal system when we can penalize lawyers instead?

Now, this will have some impact on the legal-services market. On the downside, we’ll have fewer attorneys. Law schools will get a lot less competitive as students avoid the law and the limited amount of money available through LegalCare, and existing attorneys may leave the profession as well as they fail to make enough money from the price-controlled compensation they get from the government. All this will mean longer wait times and rationing of services as people flood attorneys’ offices to demand services disconnected from the actual cost to provide them. It may take a couple of years to get a will done, so start when you’re young.

On the plus side … we’ll have fewer attorneys. And politicians! Best of all, everyone will get the same level of legal care regardless of their ability to pay, thanks to LegalCare and the government-imposed rationing of a resource to which we have a right to access at any time we want, for any reason we want.

    That was too funny, while filling me with a slight sense of foreboding at the same time. It sounds like parody now, it is parody now, but what about 10, 20 years from now??

    Oddly enough, I had exactly this thought in response to the "Death Panels" bizarreness. Since some folks objected to doctors being reimbursed for "end of life counseling" as often as once every five years, it occurred to me that those same folks might be more inclined toward reimbursing attorney fees for drawing up wills and other end of life issues.

    When people die without a will, the courts must probate their estates -- a process that only rarely goes in a direction the deceased (or family) would have preferred. Furthermore, the court process is extremely expensive, and when there are minor children involved, the governmental oversight can last as long as 18 years.

    Your proposal would, if properly handled, address these problems, cutting waste and spending in government (the courts) and attorney fees dramatically.

    Actually pre-paid legal services were a stab at that idea, and some of these programs are still offered by a handful of companies as an option - but that is disappearing quickly. As a former attorney, the free market is pretty well drying up the profession. Fewer people are willing to pay for certain documents that can be obtained online for next to free. (I can argue about the quality of some one-size-fits-all documents, but I digress.)

    Big law firms are laying off lawyers and staff at alarming rates as the recession reduces the need or desire of private businesses for legal services. Even in-house staffs are being reduced. Middle-sized firms that do not have economies of scale are quickly merging or imploding as they lose individual and business clients. Those top attorneys who do the best are in "boutique" firms with a steady and dependable stable of clients. Law schools produce too many attorneys and unlike Medical schools that control their number and graduates to ensure a perpetual shortage, attorneys are more in "shark-eat-shark" circumstances.

    Large firms are outsourcing some of the production of many legal documents (including litigation) to low-paid attorneys in India whose country shares an exqually byzantine and archaic legal system with the U.S. Any job that can be done on the Internet is subject to outsourcing and not one upon which a person can rely for long-term security. Finally, attorneys have great difficulty moving between states as many do not recognize the licenses to practice from other states. There is some reciprocity (I have it between Ohio, Illinois & New York) but Florida, California, Arizona and others do not think my qualifications in those 3 states (with essentially the same civil & criminal procedures but the courts are named differently) are sufficient for me to practice law. I can study for and pass another bar exam, though I did that when I first graduated. I took many years of continuing education courses, some in various states, that still qualfied for credit in many other states. One big problem for relocating attorneys is that a legal practice is built up over years and it takes years to restart one.

    The old joke was when a person came to an attorney for legal help and the lawyer asked "So how much justice can you afford?" Yes, I worked frequently for the wealthiest 10% of people, who had more legal, business, financial and accounting issues than the vast majority of Americans. What the middle class and poor really need is legal help with criminal matters, basic civil stuff such as renter's rights, and a significant amount of consumer protection assistance.

    We should expand legal aid across the country to provide more of these services to more people. I don't want to sound "elitist" but the majority of Americans are really not that well educated and make stupid mistakes that hurt themselves. We have a moral and ethical obligation to help those who can't help themselves. I would prefer some better national consumer protection laws with regards to most common public transactions involving buying/selling a principle residence, renting, credit cards, banking, and a few other consumer transactions.

    Middle Class and Working Poor Americans are unable to afford proper legal representation in their Civil, Criminal and Family Courts of law all across America causing tremendous hardships nationwide,but these great minds and callous hearts in our American Congress have found others Worldwide more needy then their own citizens who are being falsely incarcerated,wrongfuly executed,losing their homes or apartments,losing child custody or visitation with their children etc?

    Not being afforded proper legal representation by our U.S. Congress has created a total breakdown of the American judicial system for our poorer Americans because the our U.S. Courts punish all of us little people if we are not assisted with proprer legal counsel.*It is a known fact that our average Middle Class and Working Poor Americans without proper legal representation in all of our American Courts of law lose their legal cases to the better financed who are able to afford lawyers.

    Lawyers For Poor Americans is now actively in the hunt for International Countries and Leaders Worldwide to help raise 5 Billion Dollar$ for our slighted poorer Americans who have had their own American Congress turn their backs on their desperate needs in not affording them proper legal representation.

    Troy Davis and Mumia Abu ~ Jamal are 2 perfect examples of American citizens who never had proper legal representation or defense investigations afforded them by our U.S. Congressional Leaders Of The Free World in their initial criminal trials in (Georgia and Pennsylvania) who might very well have to pay the ultimate price of possibly being completely innocent and falsely executed in the near future.

    These two poorer Americans are among tens of thousands of legal cases nationwide that never were afforded proper legal representation or proper defense investigations at their initial trials……**We the public really have no idea if these men are innocent or guilty until they both are given fair legal representation at their new future trials.

    Improper murder trials take place in Third World Countries all the time. *** Why should average Middle~Class and Working Poor Americans in the Wealthiest Country Of The World be treated as if they are living a Third World Life Style ??
