The above is a right-wing meme that has taken root to support the Bush administration's violations of international law. Providing incentives for good behavior by giving higher levels of protection to parties who “follow the rules” is NOT the purpose of the Geneva Conventions. The purpose of the Geneva Conventions is to somewhat abate the horror of war and/or armed conflict by establishing minimum standards of treatment for ALL parties caught up or involved in such conflicts. There is no one — no category or class of human person whatsoever — who falls outside the protection of the Geneva Conventions.

If you could put your Bush/Cheney/all things conservative hatred aside for a moment and actually give the subject some thought, you would see that the execution of enemy combatants is essential to upholding the words and spirit of the Geneva Conventions.

The conventions were initiated to protect legitimate soldiers and civilians during times of armed conflict between civilized nations. Extending the same rights and protections to individuals who don’t operate under a lawful government, who don’t wear an identifying uniform and who hide among civilians would negate the very purpose of the conventions.

Agreements don’t work when only one side abides by the agreement.

Liberals love to throw out terms like “Nazi”, but very few have any idea of what the words mean. You say “torture” without any reference to what actual torture is. You equate policy decisions with crime, conflate issues and continually lie to yourselves in order to feign moral superiority. What a joke.

If anyone in the Bush administration had advocated using waterboarding or any other coercive techniques on POWs, Bush would have been impeached and tried as a criminal. Naturally, nothing of the sort ever happened.

Prisoners Of War (POWs) have rights and protections under the Geneva Conventions. Enemy combatants have none of these rights and are subject to summary execution. Anything short of placing the individuals up against a wall and killing them is an act of mercy.

The US executed Japanese for water boarding ace; that's a legal fact and a political problem for your right wing talking point. How do you wish to counter that legal precedent? Good intentions is not a legal argument. Lawyers say that mass murders are just mis-understood.

You're arguing against a legal judgment that established that water boarding is torture punishable by hanging. I think you better come up with a suitable motive for the CRIME, not argue that no crime has been committed.

I have no idea whether or not there will be convictions. Certainly the lawyers don't have convictions.

If you want cut and paste your way to a persuasive argument, at least cut and paste from the several lefty lawyer blogs where they at least acknowledge the issues at law and not just cherry-picked sentences seemingly damning but nonetheless not in context.

I'll make it easier, if you want the interrogators, prove beyond a reasonable doubt that they acted with knowledge and intent beyond the lines drawn in the opinion and without a semblance of necessity (and Cheney's memos will likely go to the necessity grounds). If you want Bybee, you'll need to establish the conspiracy argument.

Either way, likely easier to join Mullen in lobbying Obama to change his mind and roll the political dice with a truther commission.
