A murderer who gets his conviction thrown out for prosecutorial misconduct cannot be re-tried due to double jeopardy. However, that means neither he didn&#039;t commit the murder, nor was he acquitted of the offense. It just means he cannot be found guilty a second time.&lt;br&gt;&lt;br&gt;There is a huge difference between culpability for actions, and being found legally responsible. One of my favorite legal sayings is, &quot;That which is just is often not legal, and that which is legal is often not just.&quot;</description>
