The US Congress has no right to surrender the sovereignty of the United States, and this is just one step closer thereto. It is unrealistic to expect, with the mess that we're in right now, that the Obama administration will be able to focus entirely on prisoner issues. Besides, I wouldn't want him to hew strictly to the ACLU's position any more than I would want him to hew strictly to, say, John Yoo's position.
