And You Thought Your Ex Was Bitter

As a lawyer I couldn’t resist posting this story.

The basic story is that the husband donated a kidney to his wife and she subsequently had an affair. Now that they are getting divorced he wants the kidney back, or absent that he wants financial compensation.

I am not sure which is worse, the woman having an affair after he gave up a kidney or him filing this claim, when he obviously knows she will not be giving the kidney up.

    How about he pays her $15k a month (or whatever amount) in alimony and she pays him the same amount per month as restitution for the kidney?

    They had pictures of this guy on the Today Show yesterday. All they could comment on was whether or not he looked forlorn in the pictures they had. It was quite poignant commentary. They preceded that by talking about “The Office” bobble heads.

    This is an extreme case, but it does show you the inherent problems with living donation. Previously it has included pressure to give, not to return, an organ, though. [grin]

    As to the value of a kidney, well, the ethical and other problems with buying and selling organs, and the whole realm of issues with organ procurement and distribution, are an ocean of topics. It's a shame we simply don't have “presumed consent” (opt-out, not opt-in) in this country.

    1. What's next, a “pre-donation” agreement stipulating conditions for the recipient to meet and an agreement to return the organ (or donate it to someone else waiting for an organ, which makes more sense) if the condition(s) are not met?

    2. If people are curious, with cadaver donations, normally the donor's and recipients' identities are kept confidential (secret) from each other because of the frequent psychological issues.

    3. If she were extra spiteful, and had to return the organ (or chose to), she could first go back on the waiting list or prepare for dialysis, then stop taking her anti-rejection medications. You can guess the rest. “OK, chump, you can have what's left of your kidney back now.”

    That man is a bastard!!! So because they are getting divorce he wants his kidney back or else a financial compensation. If I were the wife I will kick that bastard ex.
