Quadrennial Presidential Wannabe, Alan Keyes, Sues Obama

Hopefully this is a hoax. But, knowing the sour-grapes, rabid nature of presidential wannabe Alan Keyes, I am afraid it is for real.

What will they sue for next, Obama’s writings when he was 8 years old?

Presidential candidate Alan Keyes, AIP leaders sue in CA court to obtain Obama citizenship proof, stop Secretary of State from certifying Electors
Fenton, MI November 14, 2008

Presidential candidate Alan Keyes, vice-presidential candidate Wiley S. Drake, and the Chairman of the American Independent Party, Markham Robinson, have filed suit in California Superior Court in Sacramento seeking to bar Secretary of State Debra Bowen from certifying to Governor Arnold Schwarzenegger the names of Electors, and from transmitting to each presidential Elector a Certificate of Election, until documentary proof is produced and verified showing that Senator Obama is a natural born citizen of the United States, and does not hold citizenship of Indonesia, Kenya or Great Britain.

In addition, they have asked that the court issue a peremptory writ barring Senator Obamas California Electors from signing the Certificate of Vote until such documentary proof is produced and verified.

In response to questions about why the suit was being filed, Ambassador Keyes commented, I and others are concerned that this issue be properly investigated and decided before Senator Obama takes office. Otherwise there will be a serious doubt as to the legitimacy of his tenure. This doubt would also affect the respect people have for the Constitution as the supreme law of the land. I hope the issue can be quickly clarified so that the new President can take office under no shadow of doubt. This will be good for him and for the nation.

Former Reagan administration official Ambassador Alan Keyes and Wiley S. Drake were the 2008 presidential and vice-presidential nominees of the American Independent Party, which is the California affiliate of the new national Americas Independent Party.

Mission Viejo, California attorney Dr. Orly Taitz and United Justice Foundation Executive Director Gary Kreep are representing the plaintiffs in this case.

Just a question, supposing he is disqualified, then CAs withdrawel of electorate votes would tip the balance in favor of McCain?

Just a funny aside. If you add one lawyers first name to the other's last, you get "Wiley Kreep". That pretty much says it all coming at its roots from the GOP.

Seriously though, how would this affect the election if Obama was disqualified? A special election with new DNC insert?? The DNC surrenders to McCain (Palin)? Could the DNC insert a substitute nominee as Barack's replacement? Hilllary? Biden?

How would this play out legally?

I find it interesting that Ahhhnold is participating in combing over Barack's fitness via citizenship to serve as president. Seems from his own aspiriations to preside at the Oval Office, Arnold would want a president set for a Contitutional Waver of citizenship if the person had been a citizen for a number of decades? Let me guess, the US Supreme Court will be deciding this election too?

If you took the 55 California electoral votes away from Obama (and gave them to McCain), the results would be: Obama 309, McCain 218.

Obama still wins

But if in fact Obama had committed a "crime" (I seriously doubt it), others would sue and eventually the balance would tilt...unlikely!

Sil, Obama doesn't need CA's electoral votes to win. Obama has 95 more electoral votes than necessary to win. CA represents 55 of those votes.

Keyes isn't making a real attempt at stopping Obama from becoming prez. If Keyes were making a serious attempt (and that means that Keyes also thinks his case has merit) then he would introduce similar lawsuits in enough states to actually prevent Obama from being president.

Keyes is being Keyes and can't be taken seriously. Unfortunately with a little money some quacks can even have their day in the spotlight and cause problems.

Keyes wants to remain relevant.....

This issue (and a parallel issue with the Canal Zone birth of John McCain) has been discussed quite a bit on sites such as the Volokh Conspiracy. There was a similar suit thrown out both for lack of standing and comedy relief earlier in the campaign. Since the appropriate authorities have already certified President Elect Obama's birth place and the fact that everytime the "natural born" part of the Constitution has been dealt with also states that he is eligble then it is unlikely that this suit, if it even exists, will go very far.

When I first read the headline I thought that cousin Alan was suing because he thought that Obama stole the "black candidate" meme that AK had a virtual copyright on. :grin:

This is nothing more than harassment which panders to Americans who are convinced Obama's victory represents a conspiracy. A previous suit was thrown out in Pennsylvania last month for lack of standing. There were some there who demanded that Obama prove his citizenship. Check out Politifact which has examined this issue in depth.

Has anyone ever - EVER - stopped to ask why Obama doesn't just provide the requested document to a court to be certified. THEN, he could take that result to the media - which is overwhelmingly pro-Obama- and point out that those right wing crazies are just out to get him. So, why hasn't he done it. Just a thought. Instead, he has hired several lawyers and had the charges "dismissed' on technicalities. On top of that, Justice Souter has agreed to look at the original lawsuit out of PA. The very fact that Souter has agreed to look into it should tell you there is at least some hint of something here. Justice Souter isn't exactly a conservative stalwart. So, those of you out there who are convinced it is just a bunch of bat poo-poo, just stop and ask yourselves, isn't the Constitution worth making sure that Obama is in fact an American Citizen.
