		<description>I agree.  It sounds to me as if judge Scailia is worried about the negative consequences of putting suspects thru actual trials instead of just doing whatever we want.  Since when did proving a person&#039;s guilt become something our own legal scholars wish to avoid?  &lt;br&gt;&lt;br&gt;Someone should run an experiment.   Take an obviously innocent hypothetical american citizen and run them thru the Gitmo routine.  Assuming at all points the person is detained and tried by biased and unfair individuals, is there a legal means that an innocent person could get out?  Can all legal means of proving the innaccuracies of the accusations be removed from the equation?  I see it going something like this:&lt;br&gt;&lt;br&gt;GOVT:  You are under arrest for being an &quot;illegal enemy combant&quot;.&lt;br&gt;&lt;br&gt;Innocent American: That rediculous, I&#039;m a natural born American citizen!&lt;br&gt;&lt;br&gt;GOVT: That&#039;s an interesting point sir, feel free to bring that up at your hearing.&lt;br&gt;&lt;br&gt;IA: When is my hearing?&lt;br&gt;&lt;br&gt;GOVT: We&#039;ll let you know.&lt;br&gt;&lt;br&gt;Once denied due process is there any way to extricate yourself if you run afoul of the system?</description>

In this case, the  ruling effects how the WOT is conducted.&lt;br&gt;That seems tike  a reversal of how the conservatives express their opinions when domestic situations are involved.
