Holding to the most conservative reading of the law, even if it is the most business friendly, would not be activist. Creating new president were there isn't or ruling contrary to established president may be activist. You have not shown why these ruling should be considered as anything one way or the other. Just that you don't like them. There seems to be some reasonable basis for this ruling, what it seems to highlight to me is not that "big Pharma" is bad but that the FDA should be revamped. If you do give full disclosure to the FDA and they give you the go ahead you should have some protection. That the FDA can't do what it should be doing............

Activism by the judiciary is wrong, period, and that includes activism against so-called Big Pharma.

I have more things to worry about than Shaun or anyone else on here does, I'm fully familiar with what companies like Baxter have managed to do (and no, they haven't escaped justice, any more than they have detection), and even so I'm not willing to compromise my integrity simply in order to feel better (statement deliberately ambiguous -- indicts a number of you in more ways than one).

[...] The Moderate Voice - Domestic and international news analysis, irreverent comments, original reporti... wrote an interesting post today on Big Pharma & A Killer Ruling Expected From George Bushâ??s Activist Supreme CourtHere’s a quick excerpt There is an old saying that Americans have to live with the decisions of the Supreme Court for the rest of their lives and then some, but that takes on a perverse new meaning for those who are maimed or their lives cut short by shoddily researched and falsely advertised medications that are inadequately vetted by the Food and Drug Administration and let slide by President Bush’s activist Supreme Court.
