DC Circuit Upholds the ACA

A huge victory for the Obama administration before a tough DC Circuit panel, which included two extremely prominent conservative judges (Laurence Silberman and Brent Kavanaugh, alongside liberal Harry Edwards). Silberman (joined by Edwards) upheld the ACA in its entirety, while Kavanaugh dissented … because he thought the court lacked jurisdiction to even hear the case at all.

That’ll leave a mark (perhaps literally, as the DC Circuit is very influential and Silberman in particular is a decent tea leaf for how someone like Scalia might vote). The opinions are here.

    Not such great news for all the anti-government folks. If the USA was half the great country Silberman’s appointer fluffed his fans into believing we’d have single payer by now instead of this mish mash.

    I am absolutely shocked at this ruling. I just don’t see how this is constitutional. However, I’ve downloaded the 103-page ruling :groan:, maybe there’s a good explanation.

    Note that this comment isn’t stating this plan is bad, it’s simply putting forth my opinion that I think this plan is not constitutional.
